Kagan – Clinton – Partial-Birth Abortion Ban Veto Papers

The debate then (1997) had been on whether the partial-birth abortion procedure was done for health reasons for the mother or essentially on healthy unborn children for elective reasons only… Planned Parenthood and NARAL made claims that flew in the face of medical practice by saying the three-day-long abortion procedure would somehow be able to save a woman’s life in a life-threatening medical circumstance.

From the Article at LIfeNews, The Executive Director of the National Coalition of Abortion Providers, Ron Fitzsimmons,

…signed on to that mantra but eventually relented, saying he “lied through my teeth” about the statistics and supposed reasons for the abortion procedure.

The Clinton Administration, advised by Kagan not to challenge Fitzsimmon’s embarrassing statements, still held the pro abortion line.

“The president’s position today remains what it has always been,” Kagan added, defending Clinton’s veto in the face of the admission, “that he will sign a bill banning partial-birth abortions, but only if it has an exception that will protect those women — even if few in number — who need this procedure to save their lives or prevent serious harm to their health.”

At the SCOTUS hearings, Kagan will probably take the position these were legal arguments for the President.  She must answer as to whether Ron Fitzsimmon was factually correct about the elective reasons for partial birth abortions.  It is legitimate to ask her whether numbers indicate the procedure was indeed used mainly for birth control.  Is she willing to ignore/disregard the facts to achieve the outcome her social agenda requires? She has some explaining to do… I can hear that familiar refrain already,  “As I have said before Senator, it would be inappropriate for me to take a position on any case that may come before the court.”
